1. Scope

These Terms of Service describe purchases through https://toshoknifearts.shop for delivery in Canada and the use of our online ordering facilities. The product listing, checkout information and relevant customer policies provide further information about a particular order.

2. Product Information

Before ordering, review the actual product description, dimensions, materials, intended use, care information and any safety instructions. A photograph may help illustrate an item, but your display settings can affect the appearance of colours or finishes. The item must still conform to its contractual description.

A description of a knife’s style does not guarantee a particular manufacturing method, place of origin or level of performance unless that claim is expressly made for the specific item.

3. Eligibility and Legal Restrictions

You must provide truthful information needed to complete an order and purchase only an item you may lawfully acquire at your location.

We do not intend to sell or import prohibited weapons into Canada. Whether a particular knife is lawful depends on its actual design and mechanism and the applicable rules. A listing or successful checkout does not override a prohibition. We may review an item and its destination before accepting or fulfilling an order.

Where an age or other eligibility check is legally necessary, we will explain the process and request proportionate information. If we cannot lawfully fulfil an order, we will explain the issue and promptly release or refund any amount collected.

4. Placing an Order

Select the products you wish to buy, review your basket, provide accurate billing and delivery information, choose a payment method offered at checkout and review the final order summary. The checkout controls allow you to correct information before submitting the order.

Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt unless it expressly states that your order has been accepted. We accept the offer when we expressly confirm acceptance or dispatch the goods, unless the communication clearly identifies an earlier acceptance.

5. Order Confirmations

We send purchase information to the email supplied at checkout. Please save your order confirmation and the policies relevant to your purchase.

Where applicable provincial law requires specific disclosures before purchase or a copy of the distance contract, those obligations apply in addition to these terms. If we do not accept an order, we will not retain a collected payment without promptly releasing or refunding it.

6. Prices, Taxes and Payment

The checkout displays the currency, applicable taxes and total payable before you submit the purchase. Free standard shipping applies to every accepted order, without a minimum purchase amount. We do not add an undisclosed standard handling charge after checkout.

Payment options depend on what appears in the actual checkout. We do not promise a payment method that is not presented for your purchase. If a provider cannot authorise the selected method, the order may not be completed.

7. Availability and Listing Errors

We make reasonable efforts to present accurate product and availability information. Before accepting an order, we may explain a material listing error or unavailable item and decline the offer, with prompt release or refund of any payment collected.

After acceptance, a change or cancellation is governed by the agreement and applicable law. We do not reserve an unlimited right to cancel a concluded purchase merely because another price would be preferable. We will not substitute an item without your agreement.

8. Delivery

Our usual processing time is 1–2 business days. The estimated total delivery time to Canada is 15–20 calendar days from placing the order, including processing. All accepted orders receive free standard shipping.

We provide tracking details when supported by the shipping service. A genuine disruption may affect an estimate, but it does not permit indefinite non-delivery. A more specific agreed delivery term and any applicable legal rights take priority.

9. Address and Parcel Issues

Provide a complete and accurate delivery address. Contact us promptly if you notice a mistake; changes may no longer be possible after the carrier receives the parcel.

If inaccurate information you supplied causes a failed delivery, we may discuss reasonable actual redelivery costs where legally permitted and agreed. We do not impose an automatic forfeiture of your payment. We bear responsibility for our own fulfilment mistakes and investigate parcels that are lost or reported delivered but cannot be found.

10. Safe Handling of Sharp Goods

Knives have sharp edges or points. Handle, maintain and store them safely, following the instructions provided for the actual product. Keep them out of children’s reach. Do not use a damaged item or place an unprotected blade in a return parcel.

The law applicable to transporting, possessing or using a particular knife depends on the product and circumstances. These safety directions do not excuse a defective product or an inaccurate description.

11. Returns, Refunds and Legal Remedies

We provide a 30-day voluntary return period for eligible goods, measured from delivery. Our Return and Refund Policy explains the conditions and safe return procedure. We pay the reasonable standard return cost for eligible returns and do not charge a restocking fee.

For an approved voluntary return, we aim to initiate a refund within seven calendar days after receiving and reasonably checking the item. A mandatory statutory deadline takes priority. Your bank or payment provider determines when the credit appears in your account.

Rights relating to defective, unsafe, damaged or misdescribed goods and any applicable distance-contract cancellation rights remain separate from our voluntary return service.

12. Accounts and Responsible Use

If an account is offered, protect its login information and report suspected unauthorised activity. Do not attempt to gain unauthorised access, interfere with site security, place a fraudulent order or misuse another person’s payment information.

We may take proportionate action against actual misuse. Restricting access to an account does not remove rights associated with an accepted order.

13. Website Content and Privacy

Text, photographs and other site content may be protected by rights belonging to their respective owners. You may browse the store and retain your purchase information for ordinary lawful purposes. A product name or visual style does not, by itself, establish an affiliation with another manufacturer.

Our Privacy Policy explains how information is processed. Accepting these sales terms does not, by itself, subscribe you to unrelated promotional messages.

14. Liability and Consumer Rights

Nothing in these terms excludes liability or a consumer remedy that cannot legally be excluded. This includes applicable legal warranties and rights relating to unsafe, defective or misdescribed goods.

Any limitation for other claims operates only to the extent permitted by the law that applies to the purchase. We do not claim that all goods are sold without any legal warranty.

15. Complaints and Applicable Law

Mandatory consumer protections in the province or territory relevant to a purchase remain effective. These terms do not require a consumer to surrender a jurisdiction or venue protected by mandatory law.

16. Changes

Updated terms apply to future transactions. Posting a new version does not, by itself, change an order that has already been accepted. If a provision cannot be enforced, its effect is determined under applicable law without unnecessarily affecting the other valid provisions.
